Modifications
Modifications refer to changes made to existing legal agreements, such as child support, alimony, custody, or visitation arrangements, typically due to significant changes in circumstances. For example, if a parent’s financial situation changes (such as a job loss or significant increase in income), either party may request a modification of child support payments. Similarly, changes in a child's needs, such as a medical condition, or a parent’s relocation may prompt modifications in custody or timesharing arrangements.
In order to modify a court order, the requesting party must usually prove that there has been a substantial and material change in circumstances since the original order was made. The court then evaluates the new circumstances and makes a decision in the best interest of the child or the fairness of the agreement. Modifications are designed to ensure that the legal arrangement remains fair and relevant to the current situation of the involved parties.
